CMS Sanctions Elevance Over Data Submission Failures
2 Mar
Summary
- CMS plans to suspend Elevance's Medicare Advantage enrollment.
- Sanctions stem from alleged noncompliance with data submission rules.
- Elevance used rejected USB flash drive method for data corrections.

Starting March 31, 2026, Elevance Health faces a potential suspension of new enrollments in its Medicare Advantage prescription drug plans, following proposed sanctions by the Centers for Medicare & Medicaid Services (CMS). The CMS notice, dated February 27, 2026, indicates that Elevance has allegedly failed to meet specific risk adjustment data submission requirements.
Specifically, since November 13, 2018, Elevance has reportedly not submitted data corrections through CMS's required electronic systems. Instead, the company repeatedly utilized encrypted external USB flash drives, a method explicitly rejected by the agency. This practice persisted as recently as October 10, 2025, according to the CMS.
The proposed sanctions could impact Elevance's membership and revenue growth. The company has until March 10, 2026, to provide a written rebuttal to the CMS. Elevance stated that it revised its practices in April 2023 and that current members' prescription drug coverage remains unaffected. CMS also imposed communication suspensions until deficiencies are corrected.
