Binance's EU Backdoor: Still Operating Despite License Denial

Binance, the world's largest cryptocurrency exchange, has maintained a significant presence in the European Union despite facing regulatory hurdles. Following a missed deadline for a key MiCA license, the exchange, which had announced intentions to exit the bloc, is reportedly still conducting business there. This continuation is attributed to interpretations of regulatory clauses, such as "reverse solicitation," allowing customer onboarding.

Furthermore, Binance has been directing some of its EU-based customers' trading activities to an entity located in Abu Dhabi. This strategy allows the company to operate under different governance structures. A spokesperson for Binance stated that the company adheres to all operating jurisdictions' regulations and is committed to a long-term, compliant presence in the EU.

The exchange had withdrawn its license application on June 16, just before a planned discussion by the Hellenic Capital Market Commission. This move prevented a formal decision on their application. European regulators, including the European Central Bank and the European Securities and Markets Authority, are reportedly seeking confirmation from Binance about its business wind-down in the region.

Despite these regulatory challenges, Binance continues to hold a substantial share of global spot crypto trading volume. In the six EU countries where it previously had local entities, Binance informed customers to exit the exchange. However, some customers have been permitted to resume trading via the reverse-solicitation workaround.
