Alibaba Wins Legal Battle Over Pentagon Contracts
27 Oct
Summary
- A US judge ordered the government not to deny Pentagon contracts to companies dealing with Alibaba's lobbyists.
- Alibaba sued the Pentagon after being added to a list of companies allegedly aiding China's military.
- The ruling allows Alibaba to keep lobbyists who also represent Pentagon contractors.
A US federal judge issued a preliminary injunction on Monday, ordering the government not to deny Pentagon contracts to companies based on their business dealings with firms that lobby for Alibaba. This decision came after Alibaba initiated legal action in June, following its inclusion on a Pentagon list of companies allegedly aiding China's military.
The injunction permits Alibaba to continue employing US lobbyists who also represent Pentagon contractors, thereby alleviating a key impediment to its efforts to contest the designation. Alibaba had previously dismissed numerous Washington lobbyists subsequent to the Pentagon's June action.
This designation, while not imposing formal sanctions, restricts Pentagon contracts and future purchases of listed companies' products or services. Other Chinese tech firms, including Baidu and BYD, expressed concerns about the designation's implications for international lobbying and supply chains.
Alibaba has firmly denied any military affiliations, asserting that its operations are focused on retail, logistics, and enterprise technology. The company stated in its lawsuit that the Pentagon's determinations lack factual or legal basis. The current injunction does not remove Alibaba from the Pentagon's list, a matter the company is actively contesting in court.
