Although she posted bond and was released, her attorneys sought to have the case dismissed in May. They contended that the extensive delay infringed upon her constitutional right to a speedy trial. Fayette County Judge Jason B. Thompson denied this motion, ruling that the defense waited too long to assert their speedy-trial rights and found no prejudice to Haddish's defense from the delay.
This ruling by Judge Thompson has cleared the path for the case to proceed to trial. The proceedings will now focus on the merits of the DUI and associated traffic charges filed against the actress and comedian.
