This motion comes after a previous lawsuit by Marasco against Swift's company was dismissed in September.
In the initial case, Judge Aileen Cannon ruled that Marasco did not own rights to the "common" phrases she claimed Swift had copied. Swift's legal team argues that Marasco is attempting to claim ownership of "basic themes" and "ubiquitous metaphors" found widely in art, rather than original lyrical content.
Despite the prior dismissal, Marasco filed a new lawsuit against Swift herself in February, reiterating similar allegations. Swift's attorneys are now seeking to prevent the second case from proceeding, emphasizing that the poet's claims have already been rejected by the same court.
