The Supreme Court of India has decisively quashed criminal proceedings initiated against filmmaker Sujoy Ghosh concerning a copyright infringement claim related to his 2016 film Kahaani 2: Durga Rani Singh. A bench of Justices PS Narasimha and Alok Aradhe observed that the complaint lacked substance and failed to establish any meaningful similarity between the film's script and the complainant's work.
The case originated from a complaint alleging that Ghosh had copied a script titled Sabak, which the complainant claimed to have shared in 2015. While a magistrate court had issued summons, and the Jharkhand High Court had previously declined to quash the case, the Supreme Court found these decisions lacked proper judicial consideration.
Crucially, the apex court highlighted that the Screen Writers Association's Dispute Settlement Committee had previously found no resemblance between the works. Furthermore, Ghosh's script for Kahaani 2 was registered prior to the creation of the complainant's script, rendering the infringement allegations untenable. The court emphasized the need to guard against frivolous litigation.
