Summary

- Dispute involves alleged environmental violations and route blocking.
- Khan filed defamation suit in 2022 over neighbor's tweets.

The Bombay High Court has mandated that Ketan Kakkar, a neighbor of actor Salman Khan, must delete defamatory social media posts. This directive addresses an ongoing property dispute where Kakkar had accused Khan of environmental violations and obstructing access to his property. The court emphasized that social media does not grant individuals the right to post disparaging remarks.
Salman Khan initiated a defamation suit in 2022 against Kakkar, citing tweets and YouTube videos as not only defamatory but also communally inflammatory. Khan's legal team argued that Kakkar's allegations were baseless and aimed at provoking religious sentiments, highlighting Khan's diverse family background. The court, however, noted that Khan had not sufficiently proven Kakkar was specifically referring to the actor in a particular video interview.
Intermediaries are also required to take steps to remove Kakkar's content if it has been uploaded by third parties. The court's decision underscores the legal boundaries for expressing grievances, especially concerning public figures, directing individuals to utilize official complaint channels instead of public platforms for unsubstantiated accusations.
