The producer, Simon Afram, claims to have invested more than $45 million and seven years into the film.
The lawsuit asserts that the loss of the film's digital copy, referred to as a DCP, has critically damaged its marketability and exclusivity. Afram's suit contends that potential buyers would be hesitant to invest in a film that could be leaked online at any moment.
Netflix, in a statement, disputed bearing responsibility for the loss, citing the film's delivery without standard industry safeguards. The company stated it is investigating the matter and has offered support, including monitoring piracy sites. Netflix maintains it does not own the rights to "Fortitude."
"Fortitude" stars Nicolas Cage as Dusko Popov, a spy who inspired James Bond. The film was reportedly delivered to Netflix for a screening on June 16. An email mentioned in the lawsuit indicated that multiple drives were stolen from Netflix offices, including a copy of "Fortitude."
