The Madras High Court has placed a temporary hold on the certification of the film 'Jana Nayagan,' directed by H. Vinoth and starring Thalapathy Vijay. This judicial intervention means the film, initially slated for a Pongal release, will not be cleared for screening during the festive period. The court's bench raised concerns regarding the swiftness of the appeal and whether the CBFC was afforded a fair chance to present its case. A crucial hearing is scheduled for January 21, significantly impacting the film's distribution plans.
The controversy stems from a single judge's prior order that had favored the film's certification, despite objections. The Examining Committee had initially suggested a 'UA' rating with certain cuts. However, a complaint from a committee member, alleging the film hurt religious sentiments and disrespected the armed forces, led to a referral to a Revising Committee and subsequently to this legal challenge. The CBFC argued that procedural safeguards were bypassed.
The CBFC's representative contended that they did not receive adequate time to submit their response. The court noted that the producers had announced a release date before obtaining certification, creating pressure. The Union of India was also not given sufficient time to respond. Consequently, the court has stayed the single judge's direction for 'UA' certification, pending further arguments.
