15 Sep
Summary
- Delhi High Court rejected Vimal Elaichi maker's plea.
- The court cited lack of territorial jurisdiction for dismissal.
- Maharashtra FDA notices to brand ambassadors were challenged.

The Delhi High Court has dismissed a plea filed by PB Agro LLP, the manufacturer of Vimal Elaichi, challenging show-cause notices. These notices were issued by the Maharashtra Food and Drug Administration (FDA) to the brand's ambassadors, including prominent actors. The court found the petition lacked territorial jurisdiction in Delhi, deeming Maharashtra courts a more suitable venue.
PB Agro LLP had approached the Delhi High Court after the Maharashtra FDA issued notices to actors associated with Vimal Elaichi advertisements. The company asserted that its endorsement agreements and advertising campaigns adhere to all legal requirements and that Vimal Elaichi is distinct from banned pan masala products.
The Maharashtra FDA's notices alleged that the Vimal Elaichi advertisements constituted surrogate promotion of Vimal Pan Masala, a product prohibited in Maharashtra. The regulator requested documentation to prove Vimal Elaichi's separation from the banned items and sought cessation of the promotional campaign.
