The Delhi High Court has issued an ex parte interim injunction in favor of businessman Aman Gupta, a judge on Shark Tank India. This order specifically prohibits numerous entities and online platforms from using his name, image, voice, likeness, and other personality attributes without proper authorization. The court has also mandated the immediate removal of all allegedly infringing and objectionable content, including AI-generated deepfakes and unauthorized merchandise.
Justice Tushar Rao Gedela observed that the evidence presented prima facie indicated infringement of Aman Gupta's registered trademarks and personality rights. The defendants were accused of exploiting his name, slogans, persona, and commercial identity across multiple online platforms and digital media. The injunction restrains defendants from misusing or exploiting any aspect of Gupta's persona, including through AI and deepfake technology, and from passing off goods or services as endorsed by him.
Google and other intermediaries have been directed by the High Court to immediately remove, block, or take down specified URLs. They are also required to disclose available details such as mobile numbers, email IDs, and user information linked to certain accounts identified in the legal complaint. The court specifically addressed the issue of sexually explicit material allegedly created using Gupta's personality traits, noting that such content requires urgent consideration due to the potential for unlawful financial gains and reputational harm.
Representing Aman Gupta, Senior Advocate Diya Kapur detailed how his name, image, and trademarks were being used without permission on fake event booking websites, unauthorized merchandise listings, impersonation accounts, AI chatbot services, and objectionable online content. The suit also alleged the unauthorized sale of merchandise featuring his catchphrases like "Hum Bhi Bana Lenge" and "Down, But Not Out."
The Court recognized Aman Gupta's substantial goodwill and public recognition, built through his entrepreneurial ventures, his role as co-founder of boAt Lifestyle, and his appearances on Shark Tank India. His extensive social media following, business achievements, and industry recognitions were also noted. Liberty has been granted to Gupta to inform platforms of any newly discovered infringing websites during the suit's pendency, upon which domain names may be locked or suspended. The matter is scheduled for further proceedings on August 3, 2026, and October 1, 2026.
